Welcome to Komodo Boat Charter. These Terms and Conditions (“Terms”) govern your booking, payment, and participation in all boat charter services offered through komodoboatcharter.com. By booking with us, you agree to these Terms in their entirety. Please read them carefully.
1. Booking & Reservation
All boat charter bookings are subject to availability and confirmation by Komodo Boat Charter. A booking is considered confirmed only after receipt of your payment and written confirmation from our team. Your reservation includes the dates, vessel, and number of passengers specified at the time of booking. Changes to confirmed bookings must be requested in writing and are subject to availability and applicable fees.
2. Payment Terms
A non-refundable deposit of 50% is required to confirm your reservation. The remaining balance (50%) is due 14 days prior to your charter date. Payment methods accepted include bank transfer, credit card, and PayPal. All prices are quoted in USD unless otherwise specified. Currency exchange rates are calculated at the time of payment. Late payments may result in cancellation of your reservation without refund.
3. Cancellation Policy
Our tiered cancellation policy is designed to reflect our operational costs and commitments:
- 30+ days before departure: 90% refund of total paid amount; 10% non-refundable deposit retained
- 15-30 days before departure: 50% refund of total paid amount; 50% retained
- Less than 15 days before departure: No refund; full amount retained
- No-show: Full amount forfeited
Cancellations must be submitted in writing to our office. Refunds are processed within 14 business days of cancellation approval. We strongly recommend purchasing comprehensive travel insurance that includes trip cancellation coverage.
4. Weather Cancellation Clause
Komodo Boat Charter reserves the right to cancel, delay, or reschedule your charter if weather conditions pose a safety risk. Our captain makes all weather-related decisions based on sea conditions, wind speed, and visibility. In the event of weather-related cancellation initiated by us, you will receive either a full refund or rescheduling to an alternative date at no additional cost.
5. Liability Limitations
Komodo Boat Charter operates all vessels in accordance with Indonesian maritime regulations and international safety standards. However, activities at sea involve inherent risks. By participating in our charters, you acknowledge and assume all risks associated with marine activities, including but not limited to rough seas, equipment failure, and exposure to natural elements.
Komodo Boat Charter shall not be liable for injuries, property damage, or losses arising from: (a) natural hazards and weather conditions; (b) passenger negligence or failure to follow safety instructions; (c) pre-existing medical conditions; (d) acts of God or force majeure; (e) equipment failure beyond our reasonable control.
Our liability is limited to the amount paid for your charter service. We are not responsible for personal belongings, missed flights, or consequential damages.
6. Insurance Requirements
All passengers must have valid travel insurance that includes medical coverage and emergency evacuation. While not mandatory, comprehensive travel insurance is strongly recommended. Komodo Boat Charter carries third-party liability insurance but does not cover passenger medical expenses or personal belongings. You are responsible for obtaining your own coverage.
7. Passenger Responsibilities
All passengers agree to:
- Follow all instructions given by the captain and crew at all times
- Comply with all safety protocols, including wearing life jackets when required
- Not operate the vessel or equipment without explicit permission
- Disclose any medical conditions that may affect your safety (heart conditions, pregnancy, epilepsy, etc.)
- Not consume illegal substances or excessive alcohol
- Respect marine wildlife and maintain minimum distance requirements (minimum 3-5 meters from Komodo dragons, per ranger requirements)
- Not engage in behavior that endangers yourself, other passengers, or crew members
- Abide by all Komodo National Park regulations and ranger instructions
8. Age & Medical Requirements
Children under 18 years require parental consent and supervision. Passengers with serious medical conditions (pregnancy, heart conditions, severe asthma, epilepsy) must inform us in advance. We may decline passengers whose medical conditions pose safety risks. Pregnant passengers may join trips with restrictions depending on trimester and sea conditions.
9. Komodo National Park (KNP) Compliance
All charters operate under Komodo National Park regulations. These include mandatory ranger accompaniment for dragon-viewing activities, designated landing sites, and strict wildlife protection rules. Violation of KNP rules may result in fines, vessel confiscation, or criminal prosecution by Indonesian authorities. Komodo Boat Charter is not responsible for legal consequences of passenger non-compliance.
10. Safety Protocol Acceptance
By booking, you agree to participate in a mandatory safety briefing before departure. All passengers must understand and accept the emergency procedures, including evacuation protocols, radio communication procedures, and first aid procedures. Non-compliance with safety protocols may result in immediate removal from the charter.
11. Force Majeure
Komodo Boat Charter shall not be liable for failure or delay in performing obligations due to force majeure events, including but not limited to: natural disasters, pandemic, government action, war, terrorism, or other events beyond reasonable control. In such cases, you may reschedule your charter or receive a full refund at your option.
12. Dispute Resolution
Any disputes arising from these Terms shall first be addressed through good-faith negotiation between the parties. If negotiation fails, disputes shall be submitted to binding arbitration under Indonesian law. Arbitration shall take place in Labuan Bajo, Indonesia, and shall be conducted in English.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. You agree to submit to the exclusive jurisdiction of Indonesian courts.
14. Changes to Terms
Komodo Boat Charter reserves the right to modify these Terms at any time. Changes take effect immediately upon posting to our website. Continued use of our services following any changes constitutes acceptance of the new Terms.

All content on komodoboatcharter.com — including text, photographs, graphics, logos, icons, audio clips, digital downloads, and data compilations — is the property of Komodo Boat Charter or its content suppliers and is protected by Indonesian and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from this website without prior written permission from Komodo Boat Charter.
Photographs and videos taken by our crew during your charter may be used by Komodo Boat Charter for marketing and promotional purposes unless you explicitly opt out in writing before or during your charter. Guest-taken photographs and videos are your property and may be shared freely, though we appreciate credit when sharing publicly.
Limitation of Liability
Komodo Boat Charter acts as an intermediary between guests and independent vessel operators. While we carefully vet all vessels and crews in our fleet, the vessel operator bears primary responsibility for the safe operation of the charter. Komodo Boat Charter’s liability is limited to the total amount paid for the charter service. We are not liable for: personal injury, illness, or death resulting from activities during the charter (guests participate in all activities at their own risk), loss or damage to personal property, delays caused by weather, mechanical issues, or government regulations, third-party actions or omissions, or force majeure events including natural disasters, pandemics, political unrest, or government-mandated restrictions.
We strongly recommend that all guests purchase comprehensive travel insurance covering trip cancellation, medical expenses, emergency evacuation, and personal belongings before departing for their Komodo charter. Travel insurance should specifically cover maritime activities including snorkeling and diving if you plan to participate in these activities.
Frequently Asked Questions About Terms & Conditions
What is covered under Komodo Boat Charter’s liability?
Komodo Boat Charter maintains comprehensive marine insurance covering the vessel, crew, and passengers during all chartered voyages. Our liability covers incidents directly resulting from negligence by our crew or vessel malfunction. We are not liable for losses due to force majeure, guest negligence, or pre-existing medical conditions.
Can I bring my own food and drinks onboard?
While our charters include full meal service prepared by onboard chefs, guests may bring additional snacks and beverages. Alcoholic beverages may be brought onboard for personal consumption on private charters. Please inform us of any dietary restrictions or allergies at least 48 hours before departure.
What items should I bring on my Komodo boat trip?
We recommend bringing sunscreen, a hat, comfortable clothing, swimwear, a light jacket for evenings, personal medications, a waterproof camera, reef-safe sunscreen, and comfortable walking shoes for island trekking. Snorkeling equipment is provided onboard, but you may bring your own if preferred.
What behavior is prohibited onboard?
Prohibited behaviors include smoking in cabins and enclosed areas, harassing or feeding wildlife, removing coral or marine life, littering in the ocean or on islands, excessive noise after quiet hours, and any illegal activities. Guests who violate these rules may be asked to disembark without refund.
Is there a weight limit for luggage on the boat?
While there is no strict weight limit, we recommend packing light with soft-sided bags rather than hard suitcases, as storage space on boats is limited. A reasonable guideline is one medium bag (15-20kg) per person plus a small daypack. Contact us if you need to bring specialized equipment like diving gear.
