These Terms & Conditions govern bookings made through Komodo Boat Charter (“the Company”). By paying a deposit or signing a booking confirmation, the guest agrees to be bound by these terms. 1.1 A booking is confirmed once the Company has issued a written confirmation and the guest has paid the required deposit.
1.2 The deposit is 30% of the total charter cost, payable within 7 days of the booking confirmation.
1.3 The remaining balance (70%) is due no later than 14 days before the charter departure date.
1.4 Late balance payment may result in cancellation of the booking at the Company’s discretion, with the deposit forfeit.
2.1 Cancellation by the guest:
2.2 Cancellation by the Company: if the Company cancels for any reason (vessel mechanical failure, port closure, etc.), guests receive a full refund or a re-scheduled charter at no additional cost.
2.3 Force majeure: if the trip cannot proceed due to acts of God, weather, government order, or other force-majeure events, the Company will offer a re-scheduled charter or a refund minus non-recoverable third-party fees (park fees, flight changes, etc.).
3.1 Charter prices are quoted in USD and exclude Komodo National Park entrance, ranger, and SiORA conservation fees unless explicitly stated.
3.2 Standard inclusions: vessel, crew, all meals, mineral water, tea, coffee, snorkeling gear, fuel, navigation, and dinghy tender.
3.3 Standard exclusions: park fees, alcoholic beverages, SCUBA diving gear and divemaster, airport transfers, crew gratuity, and travel insurance.
3.4 Prices may be subject to change for bookings made more than 60 days in advance, in line with park-fee revisions or fuel cost movement, with prior written notice to the guest.
4.1 Guests must hold valid travel documents (passport, visa where required) and travel insurance covering trip cancellation, medical emergencies, and dive evacuation if applicable.
4.2 Guests must follow safety briefings, captain’s instructions, and park-ranger directives at all times. Failure to follow safety instructions may result in removal from the vessel at the nearest port at the guest’s cost.
4.3 Guests must respect marine life, coral reefs, and the cultural sensitivities of local communities. No touching of marine wildlife, no removal of natural materials, no littering on islands or at sea.
5.1 The Company carries comprehensive marine liability insurance covering vessel operation. Guests are required to carry personal travel insurance covering medical, evacuation, and trip-cancellation risks.
5.2 The Company is not liable for loss or damage to personal belongings, personal injury caused by the guest’s own actions, or third-party services arranged on the guest’s behalf.
5.3 Diving activities are undertaken at the guest’s own risk. Guests must hold current diving certification appropriate to the planned dive sites, and must complete a dive declaration before any dive.
6.1 The Company reserves the right to vary the published itinerary for safety reasons (weather, sea state, mechanical issues, park-authority directives).
6.2 Where the itinerary must be altered, the Company will make best-effort substitutions to keep the trip equivalent in value. No refund is due for itinerary changes made for safety reasons.
7.1 These Terms & Conditions are governed by the laws of the Republic of Indonesia.
7.2 Any disputes that cannot be resolved by good-faith negotiation will be referred to arbitration in Jakarta under BANI rules.
